Maintaining your privacy and trust are important to us at Buffalo Games, Inc. ("Buffalo Games"). On the Buffalo Games web site (the "Site"), Buffalo Games and its affiliates collect information from users in connection with certain features and services. This privacy policy is designed to tell you how personal information is collected and used on this Site so that you can make an informed decision about using our Site, or permitting your children to use our Site. A special section of this policy addresses the additional provisions that apply to the collection of information from children under 13 years of age. Please read this policy before using our Site or submitting any personal information to us. By using our Site, you consent to the information collection and use practices described in this policy. Buffalo Games reserves the right to change this privacy policy at any time. If we decide to change our privacy policy, we will post those changes in an updated privacy policy so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. What information is collected on this Site?
In order to provide our users with certain products or services on our Site, Buffalo Games and its affiliates may collect different types of information. In particular, we occasionally may need to collect certain types of personal information in order to provide our users with particular features, services or offers. "Personal Information" as used herein means information that identifies a person or allows a person to be located. Examples of Personal Information include a first and last name, a home address, or an e-mail address. The following is a summary of the kinds of information we collect at the Site from our users, and how we collect that information:

A. Passive Collection

Our software automatically collects certain information from a user's computer when that user logs on or moves about our Site. We do not link this information to any other Personal Information the user tells us; we only use it to get a broad picture of who is on our Site and which areas our users are visiting. This information tells us what's important to our users and what isn't, allows us to make our Site more interesting and useful, and enhances security and efficiency on our Site. The two main ways in which we collect this general information are through:

  • 1. Log Files
    Log files are records of user activity collected to analyze trends, administer the Site, track users' movements, and gather broad types of information for aggregate use. The kinds of general information we collect in the log files include: The IP address of the user's computer How many people visit our Site Which pages of our Site are visited most often Which ISPs our visitors come from (e.g. AOL, MSN, etc.) Which browsers users are using to visit our Site (Netscape, Internet Explorer, etc.) Time of day users visit our Site
  • 2. Cookies
    Buffalo Games also uses "cookies" to gauge how users interact with our Site. A cookie is a piece of data stored on the user's hard drive containing information about the user. Cookies cannot execute code or deliver a virus to a computer. Usage of a cookie is not linked to any personal information, it merely helps the Site to be more efficient. Typically, a cookie enables a user's computer to load web site files faster on subsequent visits. We may also use cookies to track a user's path for security purposes, as well as to target a user's interests in an effort to enhance the user's experience on our Site. If a user wishes to block, erase, or be warned of cookies, the user may refer to the browser instructions or help screen to learn about these functions. If a user rejects a cookie, the user may still use our Site, however, the user may be limited in the use of certain areas.

B. Active Collection
At one place on our Site (Buffalo GameBuffs), we collect certain information that users voluntarily provide to us which may contain Personal Information. Our Site is stored and maintained on servers in the United States, so if you are located outside of the United States, the Personal Information you provide us will be transmitted to the United States. By submitting your Personal Information, you consent to its transfer to and storage in the United States, and its use in accordance with the terms of this Privacy Policy. Here is a brief summary of some of the areas on our Site where users may be asked to provide Personal Information:

  • 1. Registration
    One or more areas of our Site may require users to register for access. As part of the registration process, we may ask users for personal information in order to verify the user's identity, establish the account, promote security, and enable access to various online features. We may also ask users to complete a survey as part of the registration process to find out more about who is using our Site (see more on surveys below).
  • 2. Surveys, Contests, and Sweepstakes
    From time to time our site may request information from users as part of surveys, contests, or sweepstakes. Participation in these surveys, contests, or sweepstakes is voluntary, and users have the choice whether or not to disclose such information. Information requested may include contact information (such as name and shipping address), demographic information (such as post code, gender, and age level), and other information about a user's interests, preferences, opinions, and ideas.
  • 3. Product Updates and Other Communications
    We may collect information whenever a user communicates with us or asks to receive more information about Buffalo Games or Buffalo Games products, services, and events (for example, if a user sends us e-mail or signs up to receive notification of product updates or new product releases). This information may include the user's name, e-mail address, or other contact information.

How does Buffalo Games use information collected on this Site?
Buffalo Games is the sole owner of the information collected on this Site. Personal Information that is provided to Buffalo Games (such as a personal e-mail address) may be used by Buffalo Games in the following ways: to contact users or others about a user's use of the Site or about our products and services or about special events or offers to notify contest winners to respond to comments or requests to request feedback and enable us to develop and improve the Site and our products and services for internal and marketing/promotional purposes for the specific purpose for which the information was provided.

What information is shared with third parties?
We will not sell, share, or rent any Personal Information to third parties in ways different from that which is disclosed in this policy without first obtaining the user's authorization. We may disclose Personal Information to independent contractors, service providers, and consultants who are engaged by or working with Buffalo Games in connection with the operation of the Site or the provision of goods and services offered by Buffalo Games. For example, we may use outside shipping companies to ship products to contest winners. Similarly, we may partner with other parties to provide specific products or services and will share information with them in order to facilitate their provision of products or services (e.g., administration of our mailing lists, order processing and fulfillment, contest fulfillment, and customer service functions). Buffalo Games makes an effort to ensure, but cannot guarantee, that all such independent contractors, service providers, and consultants agree to maintain the confidentiality, security, and integrity of the Personal Information they obtain, and that they agree to the same level of privacy safeguards that Buffalo Games itself provides to its users. Additionally, we may share aggregated information (i.e. information we collect that does not allow a user to be personally identified or contacted; for example, demographic and site usage information) with third parties such as partners and advertisers. This aggregated data is not linked to any Personal Information. Buffalo Games reserves the right to share information with third parties if we are required to do so by law or if in our good faith judgment such action is reasonably necessary to comply with the legal process, to respond to any claims, or to protect the rights of Buffalo Games, its customers, or the public. Information about our users, including Personal Information, may be disclosed as part of any merger, acquisition, debt financing, or sale of company assets, as well as in the unlikely event of insolvency, bankruptcy, or receivership in which Personal Information could be transferred to third parties as one of the business assets of the company.

What choices do I have in the use and collection of information?
Users who no longer wish to receive promotional e-mail materials from Buffalo Games may opt-out of receiving these communications by replying to the e-mail with "unsubscribe" in the subject line, or e-mailing bgames@buffalogames.com and requesting to be taken off the list.  You can also unsubscribe to Buffalo Gamebuffs via the unsubscribe link offered on the page Site.

What security precautions are taken to protect my information online?
Buffalo Games takes commercially reasonable precautions to protect our users' information. Physical, electronic, and policy measures are in place to minimize the loss, misuse, or altering of any information we receive from users. How do links affect my privacy?

This Site may contain links to other sites. Please be aware that Buffalo Games is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our Site and to read the privacy polices of each and every web site that collects personally identifiable information. This privacy policy applies solely to information collected by this Site. Similarly, if a user enters this Site through a link from another web site, Buffalo Games is not responsible for or bound by the privacy policies or processes of that web site.

How can I update or correct Personal Information?
Buffalo Games has an interest in making sure that the information we do collect is accurate. To check, verify, correct, or update the accuracy of Personal Information collected by Buffalo Games, users may contact bgames@Buffalogames.com.

Special Provisions applicable to Children under 13
Although the Buffalo Games Site is a general audience site, some of our products and on-line activities may appeal to children under 13. In order to help protect children, no personal information is collected to use those features on the Site. In order to help protect children and to comply with applicable law, Buffalo Games takes special measures to protect the privacy of those under age 13 ("Children"). Therefore, the following provisions apply to the Kids Games portions of the Buffalo Games Site and to any user that Buffalo Games has actual knowledge is under 13:

  • Buffalo Games makes an effort to minimize the Personal Information (e.g. first and last name, address, phone number, e-mail address, etc.) that it knowingly collects from Children and generally limits the information it knowingly collects to non-personal information (e.g. screen name, gender, post code, etc.). However, from time to time, we may collect online contact information (i.e. the child's and/or the parent's e-mail address) from Children in order to conduct contests or sweepstakes, to offer various online activities and services (e.g. electronic postcards or newsletters), or to otherwise respond to a request from child. We do not condition a child's participation in any of our online activities on the disclosure of more Personal Information than is reasonably necessary to participate in the activity. In accordance with applicable law, we may also collect name and online contact information to the extent reasonably necessary to protect the safety of a child participant on the Site, to protect the security or integrity of the Site, to take precautions against liability, to respond to judicial process, or to provide information to law enforcement agencies or for an investigation on matters related to public safety.
  • Unless we have obtained parental consent to use Personal Information for some other purpose, Personal Information knowingly collected from Children is used only for the purpose for which it was collected (e.g. to respond to the child's request or notify a contest winner), and it is deleted when it is no longer needed for such purpose. Furthermore, unless we obtain parental consent to disclose Personal Information to third parties, we will not share Personal Information about Children with anyone other than the agents, consultants, and service providers who assist Buffalo Games with the operations of the Site or in providing or administering the contests, activities, products, or services offered on the Site (e.g. fulfillment houses, delivery companies, credit card processors, etc.). If Buffalo Games requests consent to collect any Personal Information about a child, the child's parent or legal guardian has the option to consent to the collection and use of the child's Personal Information without consenting to the disclosure of the information to third parties.
  • If Buffalo Games has collected any Personal Information about a child, parents can review the Personal Information their child has submitted online and request that any such information be deleted. Parents can also revoke their consent to the further collection of information from their child. All such requests must be made in a letter addressed to Marketing Manager, c/o Buffalo Games, Inc., 220 James E Casey Drive, Buffalo, NY 14206 and signed by the parent. If a parent gives us consent to collect, use, and/or disclose Personal Information from his or her child, and we make any material changes in the collection, use, or disclosure practices to which the parent has previously consented, we will notify the parent of such changes and obtain consent before using a child's information in any new way.
